THE DISTRICT COURT CONSIDERED A CRIMINAL CASE ON DOMESTIC VIOLENCE

Harm to life and health often occurs in a domestic setting, primarily due to excessive alcohol consumption.

The criminal case considered by the Miory District Court on May 30, 2023, is one of the few examples of uncontrolled behavior by a person in a state of alcoholic intoxication.

This case was heard in a field court session. Individuals prone to domestic violence and alcohol abuse were invited to participate.

The accused was charged with intentionally causing minor bodily harm to his cohabitant.

It was established that in March 2023, after consuming alcohol with the victim at their place of residence, the accused, during a quarrel arising from personal animosity, approached her, grabbed her by the shoulders, and struck her forehead against her nose. The blow resulted in a nasal bone fracture with abrasions to the face, which, according to the forensic medical examination, constitutes minor bodily harm due to short-term health disorder.

In court, the accused fully admitted his guilt, repented of his actions, and apologized to the victim.

Taking into account the mitigating circumstance of sincere repentance and the aggravating circumstance of committing the crime while intoxicated, and considering the personal information of the accused, the court sentenced him to a fine of 30 base units, amounting to 1,110 rubles, in accordance with the sanction of Article 153 of the Criminal Code of the Republic of Belarus. Based on Article 107 of the Criminal Code of the Republic of Belarus, compulsory treatment for chronic alcoholism was applied to him.

The court's sentence has not yet entered into legal force.
