The criminal case was considered by the district court
On March 24, 2023, the court of Miory District, in a field court session, considered a criminal case on the charge of a resident of the district attempting robbery.
Individuals registered with the criminal executive inspection of the Miory District Department of Internal Affairs, both serving sentences and having criminal records, were invited to the court session to participate for the purpose of preventing new crimes.
In the criminal case under consideration, it was established that in January 2023, in the evening, while intoxicated, the accused, on a sidewalk near residential buildings on one of the streets of Disna, Miory District, by snatching a woman's handbag from the victim's hands, openly attempted to steal property worth more than 400 rubles from the bag. However, due to circumstances beyond the accused's control, and due to the victim's active resistance, he did not bring his criminal intent to completion.
In the court session, the accused fully admitted his guilt, repented of his actions, and apologized to the victim.
The court, taking into account the mitigating circumstance of sincere repentance for the committed act, and the aggravating circumstance of committing the crime while intoxicated, and information about the person, sentenced the accused to 300 hours of community service.
The court's sentence has not yet entered into legal force.
In accordance with Article 49 of the Criminal Code of the Republic of Belarus, community service consists of the convicted person performing unpaid labor for the benefit of society, the type of which is determined by the bodies responsible for the application of community service, performed from four to eight hours per day.
In case of malicious evasion by the convicted person from serving the sentence in the form of community service, the court, upon the submission of the body entrusted with the execution of the sentence, may replace community service with arrest at the rate of one day of arrest for twenty-four hours of community service or with restriction of liberty at the rate of one day of restriction of liberty for twelve hours of community service. At the same time, the period of evasion from serving the sentence in the form of community service is not counted towards the period of the served sentence.
