For the information of enterprises and organizations using air conditioners and other equipment containing refrigerants

The Miory District Inspectorate of Natural Resources and Environmental Protection draws the attention of organizations, enterprises, and individual entrepreneurs using air conditioners and other equipment containing refrigerants classified as ozone-safe substances to the requirements of the Instruction on the Procedure for Inventorying Equipment and Technical Devices Containing Ozone-Depleting and (or) Ozone-Safe Substances, approved by the Resolution of the Ministry of Natural Resources dated December 8, 2014, No. 42 (as amended on May 26, 2020) (hereinafter referred to as the Instruction), which establishes a list of ozone-safe substances contained in equipment and technical devices for which inventory is carried out.

The practice of the territorial bodies of the Ministry of Natural Resources shows that in a significant number of cases, enterprises and organizations using air conditioners containing the above-mentioned refrigerants with ozone-safe substances violate the requirements of Article 13 of the Law of the Republic of Belarus of 12.11.2001 No. 56-Z "On the Protection of the Ozone Layer" regarding the failure to conduct an inventory of equipment and technical devices containing ozone-depleting and (or) ozone-safe substances included in the list of ozone-safe substances.

Enterprise D operates 2 units of Haier air conditioning equipment containing the ozone-safe substance HFC-32 (0.9 kg each) and one Haier air conditioner containing the ozone-safe substance HFC-32 (0.5 kg) (recorded on the enterprise's balance sheet since February 2022, manufactured in August 2021 in the People's Republic of China).

For reference: The Instruction establishes a list of ozone-safe substances contained in equipment and technical devices for which inventory is carried out, with item 2 specifying the ozone-safe substance HFC-32 (CH2F2, difluoromethane).

Thus, in accordance with the requirements of paragraphs 3, 6, 8, and 10 of the Instruction, the enterprise was required no later than 20.01.2023 to:

– designate a responsible person (commission) for the inventory of equipment and technical devices containing ozone-depleting and (or) ozone-safe substances;

– conduct an inventory of equipment and technical devices containing ozone-depleting and (or) ozone-safe substances at the enterprise;

– compile an inventory record indicating Haier air conditioners containing the ozone-safe substance HFC-32, in the form according to the appendix to the instruction on the procedure for inventorying equipment and technical devices containing ozone-depleting and (or) ozone-safe substances.

The work listed above has not been carried out by enterprise D, thereby violating the requirements of Article 13 of the Law of the Republic of Belarus of 12.11.2001 No. 56-Z "On the Protection of the Ozone Layer".

Administrative responsibility for this offense is provided for by Article 16.43 of the Code of the Republic of Belarus on Administrative Offenses: violation of legislation on the protection of the ozone layer entails a fine ranging from two to thirty basic units, for an individual entrepreneur – from five to one hundred basic units, and for a legal entity – up to five hundred basic units.
