REGULATION
on the "Single Window" Service
of the Miory District
Executive Committee

1. This Regulation defines the procedure for the creation and operation of the "Single Window" service of the Miory District Executive Committee (hereinafter referred to as the "Single Window" service) in order to implement the tasks and functions defined by Decree of the President of the Republic of Belarus of May 24, 2018 No. 202 "On the "Single Window" Service".

2. The terms used in this Regulation are defined in Article 1 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "On the Fundamentals of Administrative Procedures".

3. The "Single Window" service is created in the district executive committee based on a decision of the district executive committee.

4. In its activities, the "Single Window" service is guided by the Constitution of the Republic of Belarus, the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "On the Fundamentals of Administrative Procedures", the Law of the Republic of Belarus of January 4, 2010 No. 108-Z "On Local Government and Self-Government in the Republic of Belarus", other legislative acts regulating the implementation of administrative procedures, and this Regulation.

5. The "Single Window" service is a form of organizing the activities of the district executive committee in the territory of the Miory District for the implementation of administrative procedures.

6. The location of the "Single Window" service, the number and composition of specialists working in the "Single Window" service are determined by a decision of the district executive committee.

The official of the district executive committee directly responsible for organizing the activities of the "Single Window" service is appointed by a decision of the district executive committee.

Employees of the "Single Window" service are subordinate to the aforementioned official regarding the organization of the activities of this service.

7. The main purpose of the "one-stop shop" service is to ensure the reception of applications from interested persons for the implementation of administrative procedures in one place and the issuance of administrative decisions on them in accordance with the list of administrative procedures, the reception of applications and issuance of decisions for which is carried out through the "one-stop shop" service, approved by the Resolution of the Council of Ministers of the Republic of Belarus of October 17, 2018 No. 740.

8. By decision of the district executive committee, the "one-stop shop" service accepts applications and issues documents for other administrative procedures not included in the list of administrative procedures, the reception of applications and issuance of decisions for which is carried out through the "one-stop shop" service, approved by the Resolution of the Council of Ministers of the Republic of Belarus of October 17, 2018 No. 740, as well as for other issues within the competence of authorized bodies.

The specific distribution of responsibilities for the implementation of administrative procedures among the employees of the "one-stop shop" service is established by the orders of the chairman of the district executive committee.

9. The main tasks of the "one-stop shop" service are:

9.1. ensuring the implementation of the application-based "one-stop shop" principle when interested persons apply to the district executive committee for the implementation of administrative procedures;

9.2. creating conditions in the district executive committee for interested persons to submit applications for the implementation of administrative procedures in one place in accordance with paragraphs 7 and 8 of these Regulations (hereinafter referred to as applications);

9.3. providing free consultative assistance on the preparation of documents necessary for the implementation of administrative procedures;

9.4. ensuring the timely and high-quality preparation of documents necessary for the implementation of administrative procedures;

9.5. issuing administrative decisions.

10. In accordance with the main tasks, the "one-stop shop" service performs the following functions:

10.1. consults interested parties on the implementation of administrative procedures;

10.2. issues certificates (extracts) from state registers, registries, cadastres, lists, catalogs, databases and data banks, other information resources and systems, access to which is organized in the "single window" service, in accordance with the requirements of legislation on information, informatization and information protection;

10.3. explains the obligation of authorized bodies to independently request documents and (or) information necessary for the implementation of administrative procedures, except for those included in the lists of documents and (or) information provided by interested parties, as well as the rights and obligations of interested parties;

10.4. explains the deadlines for sending requests to other state bodies, other organizations, the procedure for paying for the issuance of documents and (or) information received in response to such requests, for the provision of which the legislation provides for a fee, as well as other issues related to the procedure for submitting applications, including in electronic form, preparing documents and issuing administrative decisions;

10.5. provides free of charge, as provided for by the legislation on administrative procedures, forms (blanks) of documents necessary for applying for the implementation of administrative procedures, explains the procedure for their completion and submission;

10.6. accepts applications, as well as documents and (or) information submitted with the applications, regardless of the administrative procedures' subordination;

10.7. refuses interested parties to accept applications in the manner and cases provided for by legislative acts and resolutions of the Council of Ministers of the Republic of Belarus;

10.8. prepares applications, as well as documents and/or information submitted with them, for consideration and forwards the materials to the relevant structural divisions of the district executive committee, other authorized bodies and organizations, including in the form of electronic documents (if necessary), signed with an electronic digital signature generated using a private key, the public key certificate of which is issued by the republican certification center of the State System for Managing Public Keys for Electronic Digital Signature Verification;

10.9. receives documents and/or information necessary for carrying out administrative procedures in the manner prescribed by Article 21 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "On the Fundamentals of Administrative Procedures", including taking into account information protection requirements, receives documents and/or information containing information related to commercial or other legally protected secrets, with the exception of information related to state secrets;

10.10. certifies the date and method of receiving information necessary for carrying out administrative procedures, obtained through:

the national automated information system from state registers, registries, cadastres, lists, catalogs, databases and data banks, and other information resources and systems integrated into the national automated information system;

sending requests and receiving responses in the form of electronic documents using the interdepartmental electronic document management system of state bodies;

10.11. issues administrative decisions (their copies, excerpts from them) to interested persons, regardless of the subordination of administrative procedures;

10.12. explains the procedure and deadlines for appealing adopted administrative decisions;

10.13. issues a unique identifier to interested parties to ensure access to the unified portal of electronic services of the state automated information system for submitting applications, receiving administrative decisions (notifications of administrative decisions made), and submitting (withdrawing) administrative complaints in electronic form;

10.14. maintains case files for applications in the manner prescribed by law.

11. When interested parties apply to the "one-stop shop" service for consultation on administrative procedures for which applications are accepted by the "one-stop shop" service, redirecting applicants for consultations to structural divisions of the district executive committee, other authorized bodies and organizations is not allowed.

If the resolution of an issue requires highly specialized knowledge, specialists from structural divisions of the district executive committee, other authorized bodies and organizations are involved in the "one-stop shop" service as consultants.

12. The work of the "one-stop shop" service can be organized using paper and (or) electronic forms of interaction.

13. The district executive committee:

ensures the organization of workplaces for the employees of the "one-stop shop" service: availability of necessary office equipment, stationery, and other consumables;

creates conditions for interaction, including electronic interaction, between the "one-stop shop" service and structural divisions of the district executive committee, other government bodies, and other organizations when carrying out administrative procedures through the use of the "One Stop Shop" software package, other functional subsystems of the state automated information system, and other information resources and systems.

14. Reception of interested parties at the "one-stop shop" service is carried out:

Monday, Tuesday, Thursday, Friday from 8:00 to 17:00, without a lunch break,

Wednesday from 8:00 to 20:00, without lunch break,

every first and third Saturday of the month from 9:00 to 12:00, without lunch break.

The work schedule of the specialists of the "single window" service is approved by the Administrator of Affairs – Head of the Department of Affairs of the District Executive Committee.

In case of long-term absence of a specialist (specialists) of the "single window" service (sick leave, vacation, long business trip, etc.), the operating mode of the "single window" service is established by the order of the Chairman of the District Executive Committee.

15. Servicing of interested persons in the "single window" service is carried out in order of priority and (or) by prior appointment of interested persons for a meeting.

16. The "single window" service organizes the provision of consultative assistance on issues of administrative procedures through the unified reference and information number 142.

17. Information about the employee's position, surname, first name, patronymic (if any) is posted at the workplace and on the badge of the "single window" service employee.

18. General requirements for the business style of clothing of the "single window" service employees, as well as for the premises where the "single window" service is located, are established by the Resolution of the Council of Ministers of the Republic of Belarus dated October 17, 2018 No. 741 "On some measures for the implementation of the Decree of the President of the Republic of Belarus dated May 24, 2018 No. 202".

19. Information about the work of the "single window" service is posted on the information stands of the district executive committee, on the official website of the district executive committee on the global computer network Internet.

20. The responsibility for the proper fulfillment by the "single window" service of the tasks and functions assigned to it by this Regulation shall be borne by the official of the district executive committee who directly supervises the organization of the activities of the "single window" service.
