Supervisory measures regarding compliance with the requirements of the Customs Union Technical Regulation "On the safety of equipment operating under excessive pressure" (TR CU 032/2013)

Products placed on the market of the Union must be safe. Products for which a Union technical regulation (Union technical regulations) has entered into force shall be placed on the market of the Union provided that they have undergone the necessary conformity assessment procedures established by the Union technical regulation (Union technical regulations).

State control (supervision) over compliance with the requirements of Union technical regulations shall be carried out in the manner established by the legislation of the Member States.

Gosgortekhnadzor exercises state supervision over compliance with the requirements of the technical regulations of the Customs Union, the Eurasian Economic Union in the field of industrial safety, including the Technical Regulation of the Customs Union "On the safety of equipment operating under excessive pressure" (hereinafter referred to as TR CU 032/2013).

To form a list of entities for state control (supervision) over compliance with the requirements of TR CU 032/2013, the entity is sent a checklist for completion by September 1st when planning for the first half of the year and by March 1st for the second half of the year. The form of an exhaustive list of questions is established by Appendix 8 to the Resolution of the Ministry of Emergency Situations of the Republic of Belarus dated November 16, 2020 No. 46. The entity that completes the checklist no later than 10 working days from the date of its receipt shall fill it out and send it to Gosgortekhnadzor.

Taking into account the results of the analysis of information provided by entities using the checklist, reliable information received from other entities about violations of the requirements of TR CU 032/2013, and taking into account the established risk criteria, a list of entities is formed and their selection is carried out through the "Integrated Automated System of Control (Supervisory) Activities in the Republic of Belarus".

The procedure for organizing and conducting inspections is defined by the Regulation on the procedure for organizing and conducting inspections, approved by Decree of the President of the Republic of Belarus dated October 16, 2009 No. 510.

Inspections regarding compliance with the requirements of TR CU 032/2013 can be carried out both with respect to manufacturers of the Republic of Belarus, and with respect to authorized representatives of manufacturers, suppliers, sellers, importers in the territory of the Republic of Belarus.

Authorized representative of the manufacturer means a legal entity or an individual entrepreneur registered in the territory of a member state in accordance with the established procedure, who, based on an agreement with the manufacturer, including a foreign one, carries out the conformity assessment and placing products into circulation on behalf of this manufacturer, and bears responsibility for the non-compliance of products with the requirements of the Union's technical regulations.

Since 2024, Gosgortekhnadzor has organized and conducted a series of selective inspections of compliance with the requirements of TR CU 032/2013, based on the results of which inspection reports have been prepared and handed over to the heads of the inspected entities, as well as requirements (orders) for the elimination of violations within the established timeframe. Other measures have been taken in accordance with the requirements of the legislation in this area of control (supervision), including decisions to suspend the validity of documents on conformity assessment (confirmation) in the territory of the Republic of Belarus. Officials of the inspected entities have been brought to administrative responsibility in accordance with the Code of Administrative Offenses for placing products into circulation for which mandatory requirements of the technical regulations of the Customs Union, the Eurasian Economic Union have been established.

Analyzing the results of the selective inspections carried out, typical violations of the requirements of TR CU 032/2013 can be identified, namely:

  • violation of conformity assessment schemes for equipment in accordance with clauses 46, 47, 52 of TR CU 032/2013;
  • violation of requirements for marking equipment with clear and indelible inscriptions containing information in accordance with clause 29 of TR CU 032/2013;
  • violations in the identification of equipment (elements of equipment subject to pressure are identified as industrial pipeline fittings and vice versa);
  • non-compliance in the completeness of documents substantiating the safety of equipment, taking into account all hazard factors and safety requirements characteristic of it, in accordance with clause 11 of TR CU 032/2013.

In conclusion, it should be noted that compliance with the requirements of TR CU 032/2013 guarantees the safe operation of equipment at all stages of its life cycle, i.e., from the moment the equipment is released by the manufacturer until its disposal.
