Attention developers. "Construction amnesty extended for three years"
The temporary simplified procedure for commissioning residential buildings and non-residential capital structures on adjacent land plots for citizens has been extended.
On January 13, 2025, the President of the Republic of Belarus signed Decree No. 10, which extends for three years the simplified procedure for commissioning single-family residential buildings of the fifth complexity class and non-residential structures erected by citizens without permits and design documentation (except for those located in Minsk).
Applications for the commissioning of such structures can be submitted by citizens until January 1, 2028.
The Decree will allow the legalization of unauthorized constructions erected by citizens on land plots obtained by them before September 1, 2022.
Corresponding amendments have been made to the Decree of the President of the Republic of Belarus of July 25, 2022 No. 253 "On the simplified procedure for commissioning construction objects" (hereinafter referred to as Decree No. 253).
The extension of Decree No. 253 contributes to the simplification of construction procedures for citizens and provides for the so-called construction amnesty, as well as excludes liability for unauthorized construction of objects specified in Decree No. 253.
Decree No. 253 establishes that:
- single-family residential buildings and (or) non-residential capital structures of the fifth complexity class on adjacent land plots, erected (reconstructed) by citizens on land plots, the rights to which they acquired before September 1, 2022, and intended for the construction and (or) maintenance of single-family residential buildings, may, by decision of the local executive and administrative body, be commissioned without permits for their construction (permits for reconstruction) and (or) design documentation.
Applications for the commissioning of the above-mentioned construction objects can be submitted by citizens until January 1, 2028.
- the construction (reconstruction) by citizens of single-family residential buildings and (or) non-residential capital structures of the fifth complexity class on the adjacent territory, for which a decision on commissioning has been made by the local executive and administrative body, is not recognized as unauthorized construction.
When commissioning, single-family residential buildings and (or) non-residential capital structures constructed (reconstructed) by citizens on the adjacent territory must meet the following criteria:
compliance with the fifth complexity class;
compliance with the requirements for placement within the boundaries of the allocated land plot;
readiness of the facility for commissioning.
Decree No. 253 is temporary in nature, that is, it is a temporary deviation from the general procedure for commissioning the specified facilities (applies only to citizens who received land plots before September 1, 2022, and is valid until January 1, 2028).
